TERMS OF SERVICE

1. Introduction

Win or Workout (hereinafter "the Application") is a service developed and operated by Evan Tocquet, an independent developer (hereinafter "the Publisher"). The Application provides a gamified physical activity tracker: it converts the user's performance in the video games they log into exercise targets, which the user chooses to complete as push-ups, squats or boxing.

The Application is in open beta: creating an account with Google or Discord is unrestricted. Access by nickname and access code remains by invitation only. The Publisher may refuse or revoke access.

2. Acceptance of the Terms

Use of the Application implies full and unconditional acceptance of these Terms of Service. If you do not accept these terms, you must stop using the Application immediately.

3. Access to the Application

The Application is accessible via a web browser and, on Windows, via a desktop application. Creating an account with Google or Discord is open to everyone; access by nickname and access code remains restricted to invited users. The Publisher reserves the right to modify the access conditions at any time.

Use of the Application requires an account created via Google, Discord, or a nickname and access code. A Riot Games ID may optionally be provided, with a view to automatic synchronization of League of Legends matches.

4. Acceptable Use

The user agrees to:

  • Not attempt to circumvent access limits or falsify game data
  • Not use the Application for commercial purposes without prior authorization
  • Not interfere with the proper functioning of the service
  • Provide accurate information when creating the account

5. Intellectual Property

The Application, its code, design, and content are the exclusive property of Evan Tocquet. Any unauthorized reproduction or use is prohibited.

Game names, trademarks and associated data referenced in the Application remain the property of their respective publishers. Win or Workout is not affiliated with any of them. League of Legends is a trademark of Riot Games, Inc.; the Riot Games API, where used, is used in accordance with its terms of use.

6. Limitation of Liability

The Application is provided "as is", without warranty of any kind. The Publisher shall not be held liable for service interruptions, data loss, or indirect damages related to the use of the Application.

The exercise recommendations generated by the Application are provided for informational purposes only. The user is solely responsible for the physical activity they perform and should consult a physician if in doubt about their physical capabilities.

The desktop Application may display an overlay on top of a game and, in future releases, read end-of-match information from the screen. Some game publishers prohibit any third-party software interacting with their client, and their anti-cheat systems may restrict, suspend or delete an account at their sole discretion. Users who enable these features do so at their own risk; the Publisher cannot be held liable for any sanction imposed by a game publisher.

7. Modification and Termination

The Publisher reserves the right to modify these Terms of Service at any time. Users will be informed of major changes. The Publisher may suspend or delete an account in the event of non-compliance with these terms.

8. Governing Law

These Terms of Service are governed by French law. Any dispute shall be submitted to the competent courts within the jurisdiction of the Publisher.

These Terms of Service are drawn up in French. Versions in other languages are provided for understanding; in the event of any discrepancy, the French version prevails.
